I served my first rotation in the Labour and Employment Law department. This teething phase of my legal career provided invaluable experience and harnessed my legal growth. My daily business included collaborating with the employee relations and forensics and Investigation department to ensure that ongoing investigations manifested into successful disciplinary actions; attending disciplinary hearings; drafting draft rulings, attending CCMA Arbitrations; serving and filing pleadings; attending to consultations with clients and Advocates and drafting briefs to counsel. My second rotation was in the Property department, where I got exposure to all aspects of property law Including: • legal due diligence on the property to identify any legal issues that could affect the transaction; • structuring transactions by considering factors such as the type of financing and ensuring an understanding between the lender and borrower regarding interest rates, repayment schedules and default provisions. • drafting and reviewing legal documents relating to the transaction, including loan agreements, security agreements and mortgages. • ensuring that the documents drafted reflect the terms agreed upon and comply with South African law and lending practices. • providing legal opinions and advising on legal issues/risks and devise strategies to mitigate such risks. • mortgage bond registrations and cancellations for the major financial institutions; • residential and commercial property transfers; • registration of general notarial bonds and special notarial bonds; • subdivisions and consolidations of immovable property and the registration of servitudes. • attending to the review and preparation of sale agreements, residential and commercial leases, servitude agreements, use and access agreements; • providing of legal opinions on property law-related matters; and • facilitating delivery of the original registered security documents to the financial institutions for safekeeping.
